SUBMISSION POLICY
Due to the high volume of inquiries, Foton Ventures, LLC. (“Foton Ventures”) may not be able to respond to each business inquiry (“Submission”).
By clicking the “Submit” button, you agree that:
(a) With respect to the Submission of ideas, I understand that Foton Ventures has adopted a strict policy, of refusing to accept, consider, or evaluate such material unless the person has signed written agreement (“Agreement”);
(b) Your Submission is non-binding and does not constitute an authorization, offer, acceptance of an offer, or agreement of any kind;
(c) Your Submission does not grant you the right to use any of Foton Ventures and/or its licensors’ trademarks, copyrights, patents, or other intellectual property rights;
(d) Unless otherwise set forth in a written agreement signed by a duly authorized representative of Foton Ventures, your Submission will not entitle you to any compensation or payment of any kind;
(e) Foton Ventures shall be entitled to use or disclose (or choose not to use or disclose) your Submission for any purpose, in any way, worldwide;
(f) Foton Ventures is not under any obligation of confidentiality, express or implied, with respect to the Submission; and
(g) Foton Ventures cannot guarantee that similar information has not already been developed, or will not be developed or obtained by Foton Ventures in the future, or that Foton Ventures may not already have something similar to the Submission under consideration or in development.
You acknowledge that you are making this Submission voluntarily, and Foton Ventures has no obligation to you of any kind in connection with the Material.
You represent and warrant that you are the sole and exclusive creator, author and owner of the Material, and that to your knowledge no one else has any right to the Material.
You acknowledge that other persons including other Foton Ventures employees or agents may have submitted to Foton Ventures or to others or made public, or may hereafter originate and submit or make public, similar or identical material which Foton Ventures shall have the right to use, and you understand that you will not be entitled to any compensation in the event of Foton Ventures use of such other or identical material.
You agree that Foton Ventures may use or redistribute the Submissions and their contents for any purpose and in any way.
You agree that there is no obligation for Foton Ventures to review the Submission.
You agree that there is no obligation to keep any Submissions confidential.
You release Foton Ventures its subsidiaries and assigns, and any of Foton Ventures’ employees or agents, from any liability, loss, or damage that may arise as a result of Foton Ventures’ access to the Material. You acknowledge and agree that Foton Ventures is not obligated to return the Unsolicited Material to you.
We reserve the right to adjust either this Submission Policy or the Terms of Unsolicited Submissions at any given time.
Terms of Unsolicited Submissions
PLEASE DO NOT SEND ANY SUBMISSIONS OR ANY TYPE OF MATERIAL WHATSOEVER TO FOTON PITCURES AND/OR ANY OF ITS AGENTS OR EMPLOYEES VIA ANY MEANS (INCLUDING, WITHOUT LIMITATION, VIA PHONE, MAIL, FAX OR EMAIL) OTHER THAN THE “CONTACT US” FORM.
IF YOU CHOOSE TO DISREGARD THIS POLICY, YOUR SUBMISSION WILL BE CONSIDERED AN “UNSOLICITED SUBMISSION” AND THE FOLLOWING TERMS WILL APPLY.
As a matter of strict policy, Foton Ventures’ employees, agents, representatives, officers and directors shall delete or discard any such Unsolicited Submissions without reading, forwarding, or responding to them. Therefore, any similarity between an Unsolicited Submission and any element in any of Foton Ventures’ creative work would be purely coincidental.
Based on this policy, Foton Ventures will not, and has no obligation to, treat any Unsolicited Submissions as confidential or proprietary, and will incur no liability if an Unsolicited Submissions is inadvertently opened, read or responded to by an employee or agent of Foton Ventures. You acknowledge and agree that Foton Ventures is not obligated to respond or return any Unsolicited Submission to you.
Notwithstanding the policy above, you agree that your Unsolicited Submission and its contents will automatically become the property of Foton Ventures, without any compensation to you.
Foton Ventures will not be liable for any inadvertent use or disclosure of such Unsolicited Submissions, and you shall have no claim against Foton Ventures or anyone else based on or arising out of your Unsolicited Submission.
Further, you irrevocably release Foton Ventures, its subsidiaries and assigns, and any of Foton Ventures’ employees or agents, from any liability, loss or damage which may arise as a result of Foton Ventures’ access to the Unsolicited Submissions.
